Privacy Notice
Barker Financial Group, Inc. (“BFG”) is committed to the responsible use and protection of our customers’ confidential information.
To conduct regular business, we may collect non-public, personal information from sources such as:
• Information reported by you on applications or other documents you provide to us;
• Information about your transactions with us, our affiliates, or others;
• Information from conversations digitally recorded in the data gathering process; and
• Such information as you provide to us, which may include name, address, phone number, e-mail address, Social Security number, occupation, date of birth, and information about your interests, investments, investment objectives and investment experience. It may also include information about your personal finances, information about your health (to the extent it is needed for the planning process), information about transactions between you and third parties and other information.
As BFG shares nonpublic, personal information solely to service our client accounts, we do not disclose any nonpublic, personal information about our customers or former customers to any non-affiliated third parties, except as permitted by you, i.e., to a client-designated broker-dealer, and as required by law. BFG does not sell client non-public, personal information to anyone.
Outside of the following exceptions, BFG will not share your personal information with third parties without your specific direction or consent:
a) In the course of servicing accounts, BFG may share personal information about our clients with party(ies) referring the client to us or membership group(s) of which you are a member, service providers such as client’s tax preparer, insurance company(ies), mutual fund company(ies), banks and investment firms to effect transactions, provide account maintenance or customer service to client’s account.
b) BFG may disclose personal information to companies such as your designated broker-dealer or the custodian of your account and other companies that help us process or service your transactions or account(s), including companies with which BFG may contract to print and mail your account statements. We disclose personal information to the qualified custodian, if any, with whom your funds are maintained, in order to ensure proper handling and delivery of account statements.
c) BFG may disclose or report personal information in limited situations where BFG believes in good faith that disclosure is required or permitted under law (for example, to cooperate with regulators or law enforcement authorities, resolve consumer disputes, perform credit/authentication checks, or for institutional risk control, or as consented by you). Federal regulations permit us to share a limited amount of information about you with a brokerage firm in order to execute securities transactions on your behalf, or so that BFG can discuss your financial situation with your accountant or lawyer.
d) BFG may also disclose your information to other organizations and to other party(ies) and individuals with your consent (for example, to your attorney or tax professional).
e) BFG may use your personal information to fulfill our regulatory obligations and to help us deliver services to you.
Information Safeguarding
BFG will internally safeguard your nonpublic personal information by restricting access to only those employees and agents who provide products or services to you or your accounts or those who need access to your information to service your account. In addition, BFG will maintain physical, electronic and procedural safeguards as required to comply with applicable federal and state laws, regulations and standards to guard your nonpublic personal information.
For unaffiliated third parties that receive access to your personal information, BFG also requires confidentiality in our agreements with them to keep such information private. Federal and state regulators may also review BFG’s records as permitted by law.
Personal Information of Former Clients
BFG treats our former clients’ personal information in the same manner as we treat the personal information of current clients, in accordance with this notice. Personally identifiable information about you will be maintained during the time you are a client of BFG and for the required time thereafter that such records are required to be maintained under federal and state securities laws and regulations, and consistent with the CFP Board Code of Ethics and Professional Responsibility. After this required period of record retention, all such information may be permanently stored or destroyed at our option, in compliance with the BFG’s then disposal policies.
Protection of Personal Information of Residents of the Commonwealth of Massachusetts
BFG has adopted a Privacy Notice for the Protection of Personal Information of Residents of the Commonwealth of Massachusetts to comply with 201CMR 17:00, which establishes minimum standards to be met in connection with the safeguarding of the personal information of residents of the Commonwealth of Massachusetts contained in both paper and electronic records. The objectives of the Massachusetts regulation are to insure the security and confidentiality of client information in a manner fully consistent with industry standards; protect against anticipated threats or hazards to the security or integrity of such information; and protect against unauthorized access to or use of such information that may result in substantial harm or inconvenience to any consumer.
Notices
At the commencement of our business relationship and annually thereafter, we shall provide you with a copy of our Privacy Notice. We shall provide you with notice of any changes made to our Privacy Notice or to our privacy related practices, so that you may have the opportunity to opt out of any changes.
In the event that this Privacy Notice changes in such a way that may cause your nonpublic personal information to be disclosed other than as set forth above, you will be provided with notice of that change prior to its effectiveness and you will have the right to opt out by providing notice to us within thirty days of the postmark date on the notice of such change, via mail to our address listed above, by telephone at (781) 743-2600, or by e-mail to inquiry@barkerfg.com.
